McDonalds Soda FL Man Charged With Felony For Drinking Soda Without Paying

Police say a Naples, FL man is in jail facing felony charges for leaving McDonald’s without paying for a cup of soda.

Deputies arrested 52-year-old Mark Abaire last week after the restaurant manager told them he had asked for a cup of water and then filled it with soda from the fountain machine.

The charge is petty theft, but it was increased to a felony because Abaire has previous petty theft convictions.

    Is it theft or not? If he had asked the manager for soda, he may have given it to him. What on earth is wrong with saying that this man is wrong? If he has previous convictions, should we ignore them? Is he homeless? Does he frequent the store and beg for food? There are questions and answers to consider before a knee-jerk response that he is being wronged.
